DMCA Notice of Alleged Infringement ("Notice")

Be aware that under Section 512(f) of the DMCA, any individual who knowingly misrepresents that material or activities infringe may be liable.

Counter-Notification

If you believe that the content removed (or access to which was disabled) does not infringe, or that you have authorization from the copyright holder, the copyright holder’s agent, or under the law, to use and post the content, you may send a counter-notice with the following details to our Designated Copyright Agent:

1. Your physical or electronic signature;
2. Identification of the material that was removed or to which access was disabled and the location of the content prior to its removal or disabling;
3. A statement that you have a good faith belief that the content was removed or disabled due to an error or misidentification;
4. Your name, address, telephone number, and email address, along with a statement that you consent to the jurisdiction of the federal court in Seychelles, and that you will accept service of process from the person who notified you of the alleged infringement.

If our Designated Copyright Agent receives a counter-notice, we may forward a copy of it to the original complaining party, notifying them that we may restore the removed content or cease disabling it within 10 business days. Unless the copyright owner initiates a court action seeking a court order against the user or content provider, the removed content may be reinstated, or access restored, within 10 to 14 business days or more following receipt of the counter-notice, at our discretion.

Repeat Infringer Policy

In line with the DMCA and applicable laws, we have instituted a policy of terminating, in suitable circumstances and at our discretion, users identified as repeat infringers. We may also, at our discretion, restrict access to the Site and/or terminate the accounts of individuals who infringe on any intellectual property rights of others, regardless of whether or not such infringement is repeated.
